By booking or participating in a charter with GoFishVI L.L.C. (“Company”), all participants acknowledge and agree to the following terms:

1. Acknowledgment of Risks

Participants understand that activities such as offshore fishing, spearfishing, scuba diving, snorkeling, and other water-based activities involve inherent risks, including but not limited to:

• Equipment malfunction or misuse
• Injuries from wildlife, marine life, or fishing/diving gear
• Slips, falls, drowning, or other hazards on or in the water
• Effects of alcohol or cannabis consumption, including impaired judgment or coordination
• Unpredictable weather or sea conditions
• Diving-related risks such as decompression sickness, barotrauma, or entanglement
  

Participants accept responsibility for understanding these risks and agree to take appropriate precautions.

2. Voluntary Participation

Participation in GoFishVI charters is entirely voluntary. Participants affirm that they are in good physical and mental condition to safely engage in the activities offered.

3. Responsibility for Conduct

Participants are responsible for their own actions and the actions of any guests they bring aboard. This includes compliance with safety instructions provided by the captain or crew, proper use of equipment, and adherence to all Company policies.

4. Medical Fitness and Emergencies

Participants agree to inform the captain or crew of any medical conditions that could affect their safety or the safety of others. Participants consent to the administration of first aid or emergency medical treatment if deemed necessary by the Company.

5. Equipment Use

Participants are responsible for the proper care and use of any rented or provided equipment and agree to pay for any loss or damage resulting from misuse or negligence.

6. Alcohol and Substance Use

Alcohol and smoking may be permitted onboard at the captain’s discretion. Participants acknowledge that consumption does not absolve them of personal responsibility for their actions or the risks associated with activities.

7. Indemnification

Participants agree to assume responsibility for any claims arising from their participation and to indemnify and defend the Company against any claims, including attorney’s fees, resulting from their actions or those of other participants under their responsibility.

8. Governing Law

These Terms & Conditions are governed by the laws of the U.S. Virgin Islands. If any provision is deemed invalid, the remainder will remain in effect.

9. Media Consent

Participants grant the Company permission to use images or video recordings taken during the charter for promotional purposes, without compensation.

By completing a booking, participants confirm that they have read and agree to these Terms & Conditions for themselves and any other participants included in the booking, and acknowledge that they understand the risks and responsibilities described above.
